1. Introduction
Welcome to OrchardResource ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht rental services and the website available at orchardresource.site (the "Service") provided by OrchardResource.
By securing a charter or using our Service, you consent to these Terms. Should you not consent to any part of these Terms, then you should not use the Service.
2. Service Overview
OrchardResource offers premium yacht charter services that include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate events
- Private celebrations
- Extended charters
All services are available depending on yacht accessibility and prevailing weather conditions. We hold the right to change or cease services at any time without prior notice.
3. Booking and Reservations
3.1 Booking Process
For booking a charter, you are required to:
- Be at least 18 years old
- Submit accurate and comprehensive details
- Remit the specified deposit mentioned in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is only issued after we receive the payment and send our written confirmation. We may refuse service to anybody at our sole discretion.
3.3 Availability
All yacht reservations are dependent on the availability of the vessel and appropriate weather circumstances. Reasonable efforts will be made to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All fees are expressed in € and incorporate all applicable taxes unless stated otherwise. Fees are subject to amendment without prior notice.
4.2 Payment Schedule
- Initial Deposit: 50% of the total charter fee required at the time of reservation
- Outstanding Balance: Payable 48 hours prior to the charter's commencement
- Additional fees (if applicable): Payable upon the conclusion of the charter
4.3 Payment Methods
Accepted methods of payment include major credit cards, wire transfers, and verified cheques. All payments are managed through safe, encrypted platforms.
5. Cancellation and Refund Rules
5.1 Customer Cancellations
- More than 72 hours before the start: Full reimbursement less handling fees
- Between 24 and 72 hours before start: Half refund
- Less than 24 hours prior to the start: Zero reimbursement
5.2 Cancellations Due to Weather
In case our captain determines that weather conditions are not safe, we will propose:
- Rescheduling the charter to another suitable date with no additional costs
- A full reimbursement if rescheduling isn't feasible
5.3 Mechanical Issues
Should there be mechanical difficulties with the designated vessel, we will endeavor to arrange an equivalent alternative. If another vessel is not available, we will issue a full refund.
6. Safety and Behavior Standards
6.1 Safety Protocols
All guests are expected to:
- Comply with all directives from the crew
- Use provided safety gear when necessary
- Disclose any health issues that could impinge on their safety
- Stay within the allowed areas of the yacht
6.2 Forbidden Items
Items disallowed on board include:
- Glassware
- Illicit substances
- Firearms or any weapons
- Excessive beverages not suited for moderate consumption
- Animals (except if explicitly cleared beforehand)
6.3 Conduct
Passengers should act respectfully at all times. A charter may be cut short without reimbursement if the conduct of any passenger creates a safety threat or spoils the enjoyment for others.
7. Accountability and Insurance
7.1 Our Responsibility
We are responsible only up to the amount paid for the yacht charter. We are not liable for:
- Injuries suffered as a result of guest negligence
- Theft or destruction of personal effects
- Indirect, incidental or punitive damages
- Delays brought on by weather or situations we cannot control
7.2 Insurance Coverage
Our operations and vessels are covered by extensive maritime insurance. Clients are accountable for procuring their travel and personal insurance.
7.3 Risk Acceptance
Participation in our yacht services implies acknowledgment of inherent maritime risks, and you take responsibility for your safety and health.
8. Modifications and Itinerary Adjustments
We maintain the right to alter itineraries, paths, or schedules based on factors like weather conditions, safety requirements, or operational necessities. We will attempt to provide alternatives that are comparable in quality.
9. Force Majeure
We shall not be held accountable for postponements, cancellations, or changes induced by forces outside our control, which include, amongst others:
- Severe weather
- Natural calamities
- Governmental regulations
- Port shutdowns
- Technical malfunctions
10. Privacy and Data Safety
Your individual data is managed following our Privacy Policy. You concur to the data collection and usage as outlined within our Privacy Policy by utilizing our services.
11. Intellectual Property
The content on our website, such as text, graphics, logos, and images, is safeguarded by copyright and trademark statutes. Unauthorized reproduction, distribution, or the creation of derivative contents without our express consent is prohibited.
12. Governing Legislation
These Terms are subject to the statutes prevailing in Malta. Disputes will be addressed in the courts situated in Valletta, Malta.
13. Updates to Terms
We hold the right to amend these Terms at any given time. Notifications of changes will be posted on our website with the new revision date. Your continued use of our services means you accept the changed terms.
